
KAMPALA, UGANDA- The High Court in Mpigi has declined to grant a temporary injunction to Leo Lule Kimalempakka who wanted it to restrain the National Social Security Fund (NSSF) from trespassing, utilizing, transferring, transacting or developing land at Seta 390.6 acres and 452.96 Nsimbe Estate until the final determination of the main suit.
“Whereas counsel of the applicant has emphasized Article 26 (1) of the constitution on the protection of land rights of the applicant, the same article also protects the rights of the 3rd respondent.
“Considering the circumstance of the case, and public expediency, I find and hold that the balance of convenience lies with the 3rd respondent (NSSF).
“In conclusion therefore, and in view of what I have outlined, I decline to grant the temporary injunction prayed for,
